  1. Use of the Website
    1. These Terms outline the rules for accessing and using our Website and any services we offer from our Website.

    3. By accessing or using our Website and/ or any of our services, you acknowledge having read and agreed to the content of the Terms and agree to be bound by these Terms and by our Privacy Policy.

You must not misuse our Website by introducing any viruses, spy or other type of malware, or gaining/ attempting to gain unauthorised access to the server on which our Website is stored or any server, computer or database connected to our Website. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Website will cease immediately.
  2. Registered Users
    1. You may create an account and become a registered user (“User”) of the Website if you are aged 18 years old or over. You should not register as a User and/ or create an account if you are under the age of 18.
    2. As a User you may have access to additional services and/or functionality, for example, the ability to create an account, save contact information, post User Generated Content (“UGC”) onto the Website, and receive information about promotions and special offers which are restricted to Users, if any.

Booking Terms and Conditions
Please read these Booking Terms and Conditions "Booking Terms" carefully before you complete any transactions via this Website, as these Booking Terms will apply to your transaction. If you do not agree to these Booking Terms, you must not use our Website.
Wellclubs reserves the right to change or modify these Booking Terms at any time, and without prior notice. Changes to the Booking Terms come into effect immediately, at the time of publishing on the Website. We therefore suggest that every time you wish to book any Partner’s Service through the Website, you need check these Booking Terms to ensure you understand the terms which will apply to your Booking.
  1. Definitions
    1. Unless the context requires otherwise, the following terms shall having the following meanings in these Booking Terms and Conditions:
    "Booking" means an order of one or more Partner Services placed and/ or paid by a Customer through the Website;
    "Booking Confirmation" means a written acceptance of a Booking placed through the Website by the relevant Partner (usually by email);
    "Customer" "you" and "your" means any person who books or purchases any Services offered by the Partner through the Website;
    Partner” means Wellclubs’ third party providers of spa and/or beauty or other wellness related goods and services;
    "Service" means any products and/or services of the Partner offered for purchase or booking through the Website;
    "Website" means www.wellclubs.com operated by Wellclubs.
    Reference to any gender includes all genders, references to the singular includes the plural (and vice versa).

  2. Booking Partners Services

    1. The Website allows you to book and/or pay for any Service offered by our Partners. All Services available for booking and/or purchase on our Website are provided by our Partners and not Wellclubs.
    2. Wellclubs is only responsible for taking your Booking(s) and passing those on to the relevant Partners, and for dealing with payments made by you in relation to those Bookings.
    3. The Services which you book through our Website are the responsibility of the Partner which provides them. Therefore, we are not responsible or liable for the correct execution of Booking(s) and make no guarantee as to the quality of the Service received. When you book and/or purchase a Service through the Website you establish an agreement with a Partner of your choice in respect of the provision or supply of the Service which you book.
    4. All Services shown on the Website are subject to availability and the images and/or descriptions of the Services on the Website are for illustrative purposes only and actual Services may vary from those images and/or descriptions. We require our Partners to ensure that all information provided by them for display on their page of the Website is accurate, complete and not misleading in any way but we cannot verify the information which they provide to us. It will be each Partner's responsibility to ensure that all of its Services listed on the Website are available and accurately described.
    5. Wellcubs will not deal with or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of the UAE.

  3. Placing and Processing a Booking
    1. You can place your Booking by making an appointment at a specific time/date with a particular Partner for the provision of selected Services.
    2. The booking process allows you to check and amend any errors before submitting your Booking. Please take the accuracy of the information entered, correct any errors at each stage of the booking process and before finally submitting your Booking. Once your Booking is finalised, the information entered can no longer be changed.
    3. After submitting a Booking, you will receive an email acknowledging receipt of your Booking. This does not mean that the Booking has been accepted. All Bookings are subject to acceptance by the Partner and will only be formed when you are sent a written Booking Confirmation (usually by email).
    4. If you havnt received your Booking Confirmation, we have not received your Booking and kindly request to contact us as soon as possible.
    5. If your online payment has not been authorised or confirmed, you will be directed back to the previous page. In this case, we do not consider that your Booking have taken place and shall not be obliged to offer our services.
    6. If you wish to cancel your Booking or change your appointment details (time/date) after you have received a Booking Confirmation, you shall refer to our cancellation policy below.
    7. Please note that multiple Bookings can result in multiple postings to the cardholder’s monthly statement.

  4. Price and payment
    1. Prices quoted on the Website will include all applicable fees and levies (including government charges and taxes), unless stated otherwise, and the Partner shall not charge you any additional fees on the top of the quoted price.
    2. Prices quoted on the Website may be subject to change by Partners at any time but changes will not affect Bookings in respect of which you have already been sent an Booking Confirmation.
    3. The Website contains details of a number of Services and it is possible that, despite Wellclubs' best efforts, some of the pricing and other information shown for certain Services is incorrect.
    4. Payment for all Services must be made at the time of Booking in UAE Dirhams (AED). Unless you opted for “pay at venue” option, Website uses online payment system and is able to accept online payments by Visa and MasterCard credit and debit cards in AED. The cardholder is responsible for retaining a copy of transaction records and our Booking Terms.
    5. You will be responsible for protecting the confidentiality of your user ID and any password or other security information used to access your account and proceed with payment.
    6. Any currency conversion cost or other charges incurred in making a payment will be born by yourself.
    7. Wellclubs takes reasonable care to ensure that its payment system is available and functioning at all times, but cannot guarantee continuous, uninterrupted or secure access, nor can we guarantee that the facility is virus or error free. We also try to ensure that your payments are processed promptly, but it is often difficult to predict the amount of time needed to complete processing because it is dependent upon many factors outside of our control, such as delays in the banking system or in card networks. Access to the online payment system may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to provide reasonable notice of any scheduled interruptions and will do what we can to restore the facility as soon as reasonably possible.
    8. For certain Services there could be “pay at venue” option available, which means that you can still place a Booking but pay for it directly to the Partner at the time of the appointment. In this case, you are still entering into a binding contract with the Partner in respect of your Booking and once the Booking Confirmation is received, you (or any third party receiving the Service) must pay the Partner in full. In case of “no-show” you will still be liable to the Partner for the full amount of Booking due and in all cases, be subject to the relevant Partner Terms and Conditions.
    9. All Services eligible for discounts which are available and displayed on the Website, shall be paid using online payment system.

  5. Cancellations and refund policy
    1. If you wish to cancel your Booking, the following cancellation terms will apply:
      • Full refund if cancelled within 24 hours of placing the Booking through the Website. The refund will only apply to Bookings paid through online payment system and will be made through the original mode of payment only.
      • If cancelled in less than 12 hours before the time of appointment or in case of no-show, the payment is non-refundable.
      • You can reschedule your Booking within more than 24 hours before the time of appointment by directly contacting the relevant Partner (and it will be for you and the Partner to agree a new appointment).
    2. If the Booking is cancelled by the Partner, Wellclubs will refund any payment maid online in relation to that Booking to the original mode of payment only.

  6. Complains
    1. If you experience difficulty with any of the Partners and would like to make a complain about either a Partner or its Services, please contact us at support@wellclubs.com and we will do our best to help you.
    2. Following receipt of a complaint we will contact the Partner to try and resolve the issue on your behalf.
    3. Please do bear in mind that while we will take all complaints about our Partners seriously and do what we can to help you resolve them; we are not responsible for the Service provided by the Partner.
    4. Alternatively, if you are unhappy with the Services received from a Partner pursuant to your Booking, you can speak to the Partner yourself to try and resolve the issue.

  7. Disclaimer
    1. Wellclubs does not accept liability for any loss of profits, business, income or revenue, anticipated savings, data, or other tangible or intangible losses, or for any indirect, incidental or special damages, and other matters relating to the use or inability to use the Website.

  8. General
  1. All communication and notices shall be sent to Wellclubs by email at support@wellclubs.com .
  2. If any of these Booking Terms are found to be invalid, illegal or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining terms, be deemed omitted from this Agreement and shall in no way affect the legality, validity or enforceability of the remaining terms.
  3. These Booking Terms shall be governed by the relevant laws of the Dubai Internet City, the Emirate of Dubai and the Federal Laws of the UAE.
